Terms of Use

1. Acceptance of Terms

By downloading, installing, or using CipherAttack (the "App"), you agree to be bound by these Terms of Use / End User License Agreement ("EULA"). If you do not agree, do not download or use the App. CipherAttack is developed and operated by Traiect.

2. License Grant

Traiect grants you a limited, non-exclusive, non-transferable, revocable license to download and use CipherAttack on a device you own or control, solely for your personal, non-commercial entertainment purposes, subject to the terms of this EULA. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or any content within the App.

3. Prohibited Conduct

You agree not to:

  • Use cheats, automation software (bots), hacks, mods, or any unauthorized third-party software to modify or interfere with the App.
  • Manipulate leaderboard scores through any fraudulent means, including but not limited to exploiting bugs or using multiple accounts.
  • Use an offensive, impersonating, or otherwise inappropriate display name on the public leaderboard.
  • Reverse-engineer, decompile, or disassemble the App.
  • Attempt to gain unauthorized access to any servers or systems connected to the App.

4. In-App Purchases

CipherAttack may offer optional in-app purchases (e.g., removing ads, unlocking premium features). All purchases are processed by the Apple App Store or Google Play Store and are subject to their respective terms and conditions. Traiect does not handle payment information directly. All purchases are final and non-refundable except as required by applicable law or as provided by the respective store's refund policy.

5. Rewarded Advertisements

The App may display rewarded video advertisements provided by Google AdMob. Watching a rewarded ad is always optional and grants in-game benefits. Ad content is provided by third-party advertisers and is subject to their own terms. Traiect is not responsible for the content of third-party advertisements.

6. Leaderboard Fairness

We strive to maintain a fair and enjoyable competitive environment. Traiect reserves the right to remove any leaderboard entry, reset scores, or suspend access for any user found to be cheating, exploiting game mechanics, or otherwise violating the spirit of fair play. Decisions regarding leaderboard integrity are at Traiect's sole discretion.

7. Termination

This license is effective until terminated. Your rights under this EULA will terminate automatically without notice from Traiect if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies on your devices. Traiect may also suspend or terminate your access at any time for violations of these Terms.

8. Disclaimer of Warranties

CipherAttack is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Traiect does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Traiect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the App, even if Traiect has been advised of the possibility of such damages.

10. Apple App Store — Acknowledgment

You and Traiect acknowledge that this EULA is concluded between You and Traiect only, and not with Apple, Inc. Traiect, not Apple, is solely responsible for the Licensed Application and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

11. Scope of License

The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded or other products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service. You may not sublicense the App or otherwise distribute or transfer the App to any third party.

12. Maintenance and Support

Traiect is solely responsible for providing any maintenance and support services with respect to the App, as specified in this EULA, or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

13. Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Traiect's sole responsibility.

14. Product Claims

Traiect, not Apple, is responsible for addressing any claims of the End-User or any third party relating to the App or the End-User's possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

15. Intellectual Property Rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Traiect, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

16. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

18. Governing Law

This EULA is governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

19. Changes to These Terms

Traiect reserves the right to update or modify these Terms at any time. When we make material changes, we will notify you through the App or by updating the "Effective date" at the top of this page. Your continued use of the App after changes constitutes your acceptance of the revised Terms.
